SPECIAL CONDITIONS
PACKAGE TRAVEL, TRAVEL SERVICES & RELATED TRAVEL SERVICES

These special conditions form an integral part of the travel contract concluded with BA BTS SA. Depending on the nature and combination of the travel services booked, the parties are bound by a package travel contract , either a linked travel service or a travel services contract .
These special conditions supplement the general conditions of sale of the ASBL Travel Disputes Commission (https://clv-gr.be) as well as the provisions of the law of November 21 , 2017 relating to the sale of package holidays , services related travel and travel services and , where applicable , the contractual conditions of the suppliers of the travel services .
Given the mandatory nature of the law of November 21, 2017 relating to the sale of package holidays, related travel arrangements and travel services, these general conditions cannot, at any time, waive the rights and obligations arising from this law. The provision of the law will therefore prevail at all times.
These special conditions apply to travel contracts concluded from July 1 , 2018 .​
 
BA BTS SA special conditions common to package travel, linked travel services and separate travel services.
 
Article 1 : Right of withdrawal
On the basis of article VI.53 12° and article VI.73 12° of the Code of Economic Law, the traveler cannot exercise his right of withdrawal for the provision of accommodation other than at residential purposes , transportation, car rental, catering and services related to leisure activities, if a certain date or period of execution is provided for in the contracts.
The traveler cannot invoke the right of withdrawal to withdraw from the travel contract . ​ ​
Article 2 : Protection of personal data (GDPR)
 
BA BTS SA collects the traveler's data necessary for the proper execution of the file, in accordance with EU Regulation (2016/679) – (“ GDPR ”).
The personal data communicated by the traveler are necessary for the processing of the reservation and the execution of the contract (article 6.1.b of the GDPR).
For this purpose, this personal data may be shared with BA BTS SA partners located in third countries. BA BTS SA always uses partners who guarantee a level of protection similar to that provided for in the GDPR.
With the traveler 's consent , their data may also be used to send promotional or commercial offers by email .
These personal data will also be communicated to the FPS Internal Affairs and service providers as planned and in application of the law of December 25, 2016 relating to the processing of passenger data , in accordance with directive 2016/681 of April 27 , 2016 relating to the the use of passenger data for the prevention , detection, investigation and prosecution of terrorist offenses and serious forms of crime .
As the person whose data is collected, the traveler has a right of access, a right of rectification, a right of deletion and a right of opposition. These rights can be exercised by email , mentioning the name , first name and address , as well as the reason for the contact.
In accordance with data protection legislation , the traveler has the right, at any time, to object free of charge against the processing of his data for direct marketing purposes, he has the right to access his personal information and the right to change as well as, where applicable, the right to deletion. The traveler can contact BA BTS SA for this purpose , by letter or email and providing proof of identity .
Complaints regarding data collection and processing can be addressed to the competent supervisory body .​​​
Article 3 : Definitions
For the purposes of these special conditions , the following definitions apply :
1° The traveler: the natural or legal person who uses, with or without the intervention of an intermediary, the services of BA BTS SA.
2° The company : BA BTS SA acts as a tour operator , retailer or professional active in the travel sector .
3° unavoidable and extraordinary circumstances: a situation which arises independently of the will of the party invoking it and whose consequences cannot be avoided despite all reasonable precautions .
4° Non-compliance: the non-execution or non-correct execution of the travel services which are part of the trip.
Article 4 : Pre-contractual information
All pre-contractual information (brochures, promotions, web pages, quotes, etc.) are established in good faith based on the information available at the time. Maps , photographs or illustrations are purely informative and do not imply any contractual obligation .
The pre-contractual information transferred to the traveler forms an integral part of the travel contract. Each offer from BA BTS SA is issued subject to availability and only becomes final after confirmation, unless otherwise agreed . When BA BTS SA is obliged to delete or modify a given offer , it will propose an alternative .
BA BTS SA reserves the right to correct demonstrable material errors in the pre - contractual information .
Article 5 : Obligation to provide information
5.1 Obligations regarding the provision of information
When the traveler has an essential condition for making the trip, he must communicate this when establishing the offer.
5.2 Obligations regarding documents
Before the start of the trip, BA BTS SA will provide the traveler with the travel documents .
Travel documents include necessary receipts, vouchers and tickets, information on scheduled departure times and, where applicable, final check-in time, and schedules of stopovers, connections and transfers . arrivals.
These travel documents are sent by email no later than one week before departure , after receiving the total travel amount . At the express request of the traveler, travel documents can also be sent by mail, subject to payment of a supplement. If the reservation was made less than one week before departure, the travel documents will be immediately made available by email after full payment of the travel amount .
Each traveler must be in possession of valid identity documents for the booked trip. For example, the traveler must have the various documents required by the authorities of the countries he is visiting. Identity papers and passports must be valid for at least 6 months after returning from the trip .
Travelers who do not have Belgian nationality are required to contact the embassy or consulate in order to obtain the correct information on the necessary identity documents . BA BTS SA does not guarantee the accuracy of this information and declines all liability in the event of negligence on the part of the traveler in this area.
Minors must also be in possession of an identity document (kids-ID). If a minor is traveling alone or with only one parent , written authorization from both parents is required .
The traveler must present a marriage certificate for honeymoons .​​​ The certificate can be requested at any time by travel service providers .​​
5.3 Obligations regarding flights​
Timetables are communicated subject to reservation and may be modified before and during the trip. BA BTS SA informs the traveler of this change without delay.
The traveler is obliged to present himself in time to board.
The traveler must respect the authorized limits prescribed for baggage. Additional costs in the event of excess weight are entirely the responsibility of the traveler.
In the event of loss or damage to baggage , the passenger is required to report it immediately to the relevant company at the airport. The traveler must complete a 'property irregularity report' form at the airport 's lost baggage department. If transport is carried out by coach, a certificate must be requested from the accompanying employee .
Airlines blacklisted by the European Commission pursuant to EU Regulation 2311/2005 of December 14 , 2005 are available at the following address : https://ec.europa.eu/transport/modes/air ​​​​​​ /safety/air-ban/search_en
The identity of the operating airline will be communicated to the traveler at the latest on the travel documents .
5.4. Health
The traveler is required to obtain the necessary information on health formalities at the chosen destination himself .
The traveler declares that he or she is medically, physically and psychologically capable of making the chosen trip. Travelers with a physical or psychological disability , reduced mobility or an illness requiring treatment or who are pregnant must inform BA BTS SA . ​​
BA BTS SA reserves the right to refuse a traveler a trip for objective and non - discriminatory reasons if it appears that the traveler is not able to participate .
Travelers are advised to consult the FPS Foreign Affairs website on health and safety conditions.
The traveler must take care of any vaccinations themselves. BA BTS SA does not have a medical authority, the traveler must evaluate the information provided by a competent doctor or a competent medical authority .
Article 6 : Establishment of the agreement
Unless otherwise agreed, the travel contract is concluded when the traveler receives written confirmation of the trip and, if a deposit is requested, after payment of the deposit .
Article 7 : Price and payment terms​
7.1 Price setting and description
The traveler acknowledges having received clear and understandable information on the price when concluding the contract . ​​
The traveler is responsible for all charges, surcharges and costs which could not reasonably have been foreseen at the time of conclusion of the contract, such as tourist tax , entrance fees , etc.
BA BTS SA is not bound by obvious material errors in the price and has the right to rectify these errors .
7.2 Payment of the deposit – total amount of the trip
Unless otherwise stipulated, the traveler pays a deposit of 30% of the total amount of the trip when signing the travel contract . The balance of the price will be paid no later than 1 month before departure .
If the trip is booked only 1 month or less before departure , the traveler pays the full amount of the trip immediately .
Some travel services require full payment at the time of confirmation (airline tickets, train tickets, hotel reservations , insurance, vouchers ).
After payment of the full ticket price, written confirmation of payment and/or travel documents are provided to the traveler.
 
7.3. Cash payments​
Cash payments are only accepted for a maximum of €3,000.00, regardless of the total travel amount .
 
7.4. Failure to pay (on time )
BA BTS SA will not deliver travel documents in the absence of timely payment .​​
If the traveler fails to pay the advance or the travel amount , BA BTS SA will terminate the contract with the traveler automatically and without notice . Cancellation costs are the responsibility of the traveler .
In addition , in the event of non-payment on the due date, interest of 8 % per year will be due automatically and without prior notice , each month forming a full month .
In addition , in the absence of payment on the due date, fixed compensation of 10 % of the total amount of the trip, with a minimum of € 75.00 per file, is due automatically and without prior notice .
The aforementioned interest and compensation is also applied to cancellation fees, except when these cancellation fees are reimbursed by travel insurance .
Article 8 : Complaint procedure​
The traveler must make his complaints known in the following manner. During the trip :

  • First, the traveler must contact the emergency number of the tour operator or local agent indicated on the voucher or travel documents .

  • Then, the traveler must contact their BTS Travel – Travel Experts (BA BTS SA) agent who organized the trip. Contact details for this agent can be found at www.btstravel.be or www.travel-experts.be/fr ​​

  • When none of the above persons are available, the traveler should contact the contact center at +32 3 242 04 94 .

Each complaint in this context will be assessed by the organizer based on the concrete circumstances and the nature of the booked trip .
If the breach during the trip is not resolved as desired , the traveler can always submit a complaint after the trip to BA BTS at info@btstravel.be ​​
Article 9 : Applicable law and competent court
In the event of a complaint, the complaints procedure provided for in the general travel conditions of the Travel Disputes Commission ( article 17) takes priority.
When filing a complaint, the traveler must submit all relevant supporting documents. Only complaints submitted with proof can be considered . ​
Firstly , in the event of a dispute, the parties will organize joint informal consultations in which both parties will actively participate and where the reason and content of the dispute will be discussed. The parties will endeavor to achieve an amicable settlement .
If this attempt at an amicable settlement fails, the parties may ask the conciliation unit ( amicable settlement and arbitration ) of the ASBL Travel Disputes Commission to agree on a conciliation procedure .
If no conciliation procedure is instituted or fails, the claimant may initiate arbitration proceedings with the ASBL Travel Disputes Commission or refer the matter to court .
The competent court is the court of Brussels, district of Brussels, which will apply Belgian law exclusively .

Special package travel conditions
 
Article 1: Scope of application
These special conditions apply to package travel booked from July 1, 2018 and are governed by the law of November 21, 2017 relating to the sale of package travel, related travel arrangements and travel services .
 
Article 2: Pre-contractual information
The traveler acknowledges having been informed by BA BTS SA of all the pre-contractual information provided for in article 5 of the law of November 21 , 2017 relating to the sale of package holidays, related travel arrangements and travel services , namely :
1° the main characteristics of the travel services ;
2° the commercial name and geographical address of BA BTS SA, as well as its company number and contact details ;
3° the total price of the package trip , as well as taxes and all additional fees , surcharges and other costs ;
4° the payment terms ;
5° the minimum number of people required to carry out the package trip and the deadline for possible termination of the contract if this number is not respected ;
6 ° general information on passport and visa requirements in the country of destination ; ​​
7° communication that the traveler may terminate the contract at any time before the start of the package trip upon payment of appropriate cancellation fees or, where applicable, standardized termination compensation;
8 ° information on optional or compulsory insurance policies .
The pre-contractual information may only be modified if the parties to the package travel contract expressly and mutually agree to this . BA BTS SA informs the traveler of all changes to the pre-contractual information in a clear, understandable and correctly presented manner before the conclusion of the package travel contract .
 
Article 3 : Price and payment terms​
1. Price setting and description
The price is determined in the travel contract at the time of conclusion of the contract and includes all travel services listed in the contract, as well as all taxes and, where applicable, possible additional fees, surcharges and other costs.
After receipt of written confirmation of the trip , a payment obligation arises on the part of the traveler.
 
2. Price change
After the conclusion of the package travel contract , prices can only be changed if this is expressly provided for in the contract and if the traveler is entitled to a price reduction pursuant to article 22 of the law of November 21 , 2017 relating to the sale of package holidays , linked travel arrangements and travel services .​​​
In this case, the package travel contract will indicate how the price change is calculated. The price can only be changed as a direct result of changes in:
2.1° the price of passenger transportation attributable to the increase in the cost price of fuel or other sources of energy;
2.2° the amount of taxes or fees on travel services included in the agreement, which are collected by third parties not directly involved in the execution of the trip , including tourist taxes , landing fees and departure or arrival taxes at ports and airports ;​​
2.3° the exchange rate that matters for the trip .
Any price increase will be communicated by BA BTS SA to the traveler no later than 20 days before the start of the trip, on a durable medium, indicating the reasons for this price increase, a calculation and, where applicable , the date of determination . fuel .
If the increase exceeds 8% of the total price , the traveler may cancel the contract without notice compensation .
In the event of a reduction in the above-mentioned costs after the conclusion of the contract and before the start of the trip, the traveler is entitled to a proportional price reduction. In this case, only administrative costs will be charged. These costs can be justified at the express request of the traveler.
 
Article 4 : Modification of the travel contract before departure​
1. Modification by the traveler
The traveler cannot make any unilateral changes, unless the parties to the package travel contract explicitly and mutually agree to this .
Any modification at the traveler 's request will result in the payment of a fixed administrative fee of € 30.00 per person , plus any costs of the travel organizer , retailer or travel service providers .
The traveler must send his request for modification in writing to BA BTS SA by e-mail with acknowledgment of receipt or by registered mail .
A change will only be possible based on availability and taking into account any price adjustment. The costs of this change are the responsibility of the traveler.
 
2. Change by the organizer
BA BTS SA reserves the right to make minor modifications before departure . ​ The traveler is informed of this via a durable data carrier .
When BA BTS SA must materially modify the travel contract , the traveler may accept this change or terminate the contract without paying cancellation fees. The traveler must notify BA BTS SA of his choice within a reasonable time (at the latest 48 hours ) after sending this information .
BA BTS SA is also authorized to correct material errors .
 
Article 5 : Assignment of the contract by the traveler
The traveler who informs the organizer within a reasonable period ( at the latest 7 days ) before the start of the package trip via a durable medium may transfer the package travel contract to a person meeting all the conditions that apply to this CONTRACT.
In the event of assignment of the contract, the assignor and the assignee are jointly and severally liable for payment of the outstanding amount as well as any additional fees , surcharges and other costs resulting from the transfer.
BA BTS SA informs the traveler transferring the contract of the actual costs of the transfer. These costs cannot exceed the actual costs borne by BA BTS SA due to the transfer of the package travel contract .
In some situations, the cost of the transfer can be up to 100%, i.e. the cost of purchasing a new travel service ( e.g. with non - changeable or refundable plane tickets , full flights ,
…).
If a specific travel service can no longer be provided after a transfer request, BA BTS SA cannot be held responsible .
 
Article 6 : Termination of the travel contract by the traveler
1. The traveler may cancel the travel contract at any time before the start of the trip, upon payment of an appropriate and justified cancellation fee .
The traveler must notify BA BTS SA in writing by e-mail with acknowledgment of receipt or by registered mail. The date which is valid and which is used for cancellation will always be the working day following the actual receipt of the registered letter or confirmation of receipt of the e -mail .
The insurance premium is always due in addition to the cancellation fees .
The package travel contract may stipulate a standardized and reasonable termination fee based on the timing of the cancellation before the start of the package tour , the expected cost savings and income from alternative use of the travel services .​​​
If no standardized cancellation fee has been defined, the cancellation fee amount is the price of the package tour , less cost savings and income from alternative use of the travel services .
If the costs of the travel service provider exceed the standardized termination fees, BA BTS SA reserves the right to invoice the traveler for these costs .
 
2. Notwithstanding Article 6.1., and without prejudice to Article 6bis., the traveler has the right to terminate the package travel contract before the start of the trip without paying a termination fee, if exceptional and unavoidable circumstances arise. , occurring at the place of destination or in the immediate vicinity thereof have significant consequences on the execution of the package trip or on the transport of passengers to the place of destination. In the event of termination of the package travel contract under this article , the traveler is entitled to a full refund of payments made in respect of the package travel but not to additional compensation .
 
6bis. Termination of the package travel contract by the traveler in the context of the health crisis linked to Covid - 19
6bis.1.
The notion of “ exceptional and unavoidable circumstances ” as set out in article 6.2 of these special conditions, and which allows the traveler to terminate the package travel contract without compensation, is defined, in accordance with European directive 2015/2302, as being “a situation beyond the control of the party invoking this situation and the consequences of which could not have been avoided even if all reasonable measures had been taken ” .
 
6bis.2.
As part of the health crisis linked to Covid-19, the FPS Foreign Affairs has established lists on its website www.diplomatie.belgium.be in order to inform travelers of the health situation in other countries. These lists are adapted and/or modified every week by the FPS Foreign Affairs . The FPS Foreign Affairs also informs travelers of the precautionary measures to take when departing from and returning from certain countries .
 
6bis.3.
The traveler undertakes to read the updated lists of the FPS Foreign Affairs before booking their trip, and the precautionary measures imposed. The organizer will draw the traveler's attention, at the time of booking , to these lists, and will also inform them of optional and/or mandatory cancellation/repatriation insurance .
 
6bis.4.
In any event , to the extent that the traveler :​

  • has all the information related to the health crisis ( Covid -19), both in Belgium and abroad, through the FPS Foreign Affairs , thus being public information accessible to all ;

  • is aware and informed that the color - coded lists established by the FPS Foreign Affairs are subject to regular modifications so that the color of a country may change between the date of booking the package trip and the date of departure ;

  • is informed of the risks associated with such a change of color code, particularly with regard to precautionary measures upon returning from a country in the red zone ;

  • is aware and informed that the precautionary measures imposed upon return to Belgium may be modified at any time by the FPS Foreign Affairs ;

he may in no case invoke the possible change of the color code of the country of destination before the departure of the trip, or a possible change in the precautionary measures imposed by the FPS Foreign Affairs , as an exceptional and inevitable circumstance to terminate the contract without compensation within the meaning of article 6.2.
More generally, as long as the travel remains authorized by the FPS Foreign Affairs, no reason linked to the health crisis can be considered an exceptional and unavoidable circumstance within the meaning of article 6.2. The traveler retains his right to terminate the package travel contract before the trip , in accordance with article 6.1 and therefore upon payment of termination compensation .​
 
Article 7 : Complaints procedure – non - compliance and assistance
The traveler is required to inform BA BTS SA without undue delay of any non-compliance observed on site. The traveler must report non -compliance as soon as possible .
The traveler must be able to send messages, requests or complaints regarding the package trip directly to the retailer from whom the trip was purchased. The Retailer will forward these messages, requests or complaints to the Organizer without undue delay .
 
Article 8 : Responsibility of the organizer
When BA BTS SA acts as organizer , it is responsible for the proper execution of the travel services included in the package travel contract, whether these services are provided by the organizer or by other travel service providers .
BA BTS SA is not responsible for excursions or trips not included in the package trip and booked by the traveler through local merchants .
 
Article 9 : Reseller liability​
If BA BTS SA acts as a retailer between the traveler and the travel organizer of the services rendered, only the organizer is responsible for the proper execution of the travel services. BA BTS SA does not assume this responsibility.
BA BTS SA cannot be held responsible for failures in the execution of the contract attributable to the traveler and third parties .
 
Article 10 : Liability in the event of a reservation error
BA BTS SA is responsible for any errors due to a technical defect in the reservation system and, if it has agreed to organize the reservation of a package trip, it is also responsible for errors made during the reservation process .
 
Article 11 : Protection in the event of insolvency
BA BTS SA is insured against insolvency with the Travel Guarantee Fund, Avenue de la Métrologie 8, 1130 BRUSSELS, as a guarantee of the repatriation of travelers and the reimbursement of all sums paid .
Special conditions for linked travel services
 
Article 1 : Scope of application
These special conditions apply to linked travel services booked from July 1, 2018 and are governed by the law of November 21 , 2017 relating to the sale of package holidays, linked travel services and travel services .
Not all obligations relating to package travel apply to linked travel services . ​​​
 
Article 2 : Obligation to provide information
1. Information obligation of BA BTS SA
The traveler acknowledges having been informed by BA BTS SA on :
1.1° The fact that he does not purchase a package trip and therefore cannot assert the rights which apply exclusively to package trips ;
1.2 ° The fact that each travel service provider is only responsible for the proper contractual execution of its own services ;
1.3° The protection offered in the event of insolvency.
The traveler acknowledges having received the required standardized form from BA BTS SA.
In the event of non-compliance with the aforementioned information obligation, BA BTS SA will be held responsible for the proper execution of the entire trip and the obligations of the package tour with regard to the transfer of the contract, termination , liability in the event of non - compliance, contact, obligation of assistance, as well as price reduction and compensation will apply .
 
2. Traveler 's information obligation
The traveler who concludes a linked travel service must provide the professional who facilitates this service with all useful information that may be important for the conclusion or execution of the contract.
If the traveler provides incorrect information and this results in additional costs for the professional, these costs may be charged.
 
Article 3 : Determination of price and payment obligation​
The price is determined separately in each contract.
After receipt of written confirmation of individual agreements , a payment obligation is entered into by the traveler .
 
Article 4 : Termination, modification and transfer of the contract
Travel Services may only be terminated , modified or transferred if the relevant Travel Service Provider agrees to this and on its terms . ​​
Any termination, request for modification or transfer must be sent by email to the agent of BA BTS SA with whom the travel contract was concluded. The person will then contact the supplier of the travel service concerned.
Terminations or requests for changes or transfers that are made outside of business hours are deemed to have been received on the next business day .
 
Article 5 : Complaints procedure – non - compliance and assistance
The traveler must address complaints regarding any non-compliance of the travel service directly and without undue delay to the supplier of the travel service concerned . In this case, it will also inform BA BTS SA of this non-compliance.
 
Article 6 : General liability
BA BTS SA is in no way responsible for the proper execution of the travel services. This responsibility lies with the provider of the travel services concerned.
 
Article 7 : Responsibility for reservation errors​​
BA BTS SA is responsible for any error due to a technical fault in the reservation system which it is responsible for and which it commits during the reservation process if it has agreed to pay for the reservation of a travel service .
BA BTS SA is not responsible for booking errors due to the traveler or caused by unavoidable and extraordinary circumstances.
 
Article 8 : Protection in the event of insolvency
BA BTS SA is insured against insolvency with the Travel Guarantee Fund, Avenue de la Métrologie 8, 1130 BRUSSELS, for reimbursement of payments it receives and, when it is responsible for the transport of passengers , for repatriation passengers .
BA BTS SA is only protected against insolvency with respect to payments actually received by it and only to the extent that the travel service cannot be performed due to its own insolvency .​​​​​
Special conditions for the sale of separate travel services
 
 
Article 1 : Scope of application
These special conditions apply to separate travel services booked from July 1 , 2018 and governed by the law of November 21 , 2017 relating to the sale of package holidays, linked travel arrangements and travel services .
 
Article 2 : Obligation to provide information
1. Information obligation of BA BTS SA
The traveler acknowledges having been informed by BA BTS SA prior to the conclusion of the travel service contract :​
1.1° information obligations in Book VI of the Code of Economic Law ;
1.2° information on the protection to which the traveler can claim in the event of insolvency ;
1.3° the name of the entity responsible for protection in the event of insolvency, as well as its contact details, including the geographical address, as well as, where applicable, the competent authority designated for this purpose by the Member State concerned and their contact details.
 
2. Traveler 's information obligation
The traveler who subscribes to a separate travel service must provide the professional who sells this travel service as an intermediary with all useful information that may be of importance to the conclusion of the travel service contract or its execution .
If the traveler provides incorrect information and this results in additional costs , these may be charged .
 
Article 3 : Determination of price and payment obligation​
The price is determined in the travel service contract at the time of conclusion of the contract, together with all taxes and , where applicable , all additional fees , surcharges and other costs .
After receipt of written confirmation from the travel service, the traveler is subject to a payment obligation.
 
Article 4 : Termination, modification and transfer of the contract
The travel service is only terminable, changeable or transferable if the relevant travel service provider agrees to this and on its terms.
Any termination, request for modification or transfer must be sent by email to the agent of BA BTS SA with whom the travel contract was concluded. The person will then contact the supplier of the travel service concerned.
Terminations or requests for changes or transfers that are made outside of business hours are deemed to have been received on the next business day .
 
Article 5 : Complaints procedure – non - compliance and assistance
The traveler must address complaints regarding any non-compliance of the travel service without undue delay and directly to the supplier of the travel service concerned. In this case, it will also inform BA BTS SA of this non-compliance.
 
Article 6 : Liability
BA BTS SA is in no way responsible for the proper execution of the travel service. This responsibility lies with the supplier of the travel service concerned .
 
Article 7 : Protection in the event of insolvency
BA BTS SA is insured against insolvency with the Travel Guarantee Fund, Avenue de la Métrologie 8, 1130 Brussels, as a guarantee of the repatriation of travelers and the reimbursement of all sums paid .
